Terms & Conditions

NO PURCHASE IS NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCE OF WINNING. Void where prohibited. Giveaways are sponsored by T&C Surf 99-807 Iwaena St. Unit 1 Aiea, HI 96701 (“Sponsor” or “T&C Surf”). Internet participants: The promotions are intended for viewing and participation by all individuals within the following regions: US and Hawaii and Alaska only. Do not proceed with this contest/giveaway/sweepstakes (the “Giveaway”) if you are outside of eligible areas. Eligibility: Open only to individuals 18 years of age or older, with Internet access prior to the start date and time of the Giveaway. Employees, officers, and directors of Sponsor and its parent, affiliated, and subsidiary companies, distributors, retailers, licensors, advertising and promotional agencies (collectively, “Sponsor’s Entities”) (and the immediate family members, including parents, spouses, children, and siblings, of all of the foregoing) are not eligible to participate or win. 

To Enter: During the specified Giveaway period (Entry Period: October 2nd 6am HST - October 31st 11:59 PM HST), you may enter by filling out the T&C Surf General Contest Entry Form. One winner will be chosen. 

Agreement to Rules: By participating, the Contestant (“You”) agree to be fully unconditionally bound by these Rules, and You represent and warrant that You meet the eligibility requirements. In addition, You agree to accept the decisions of T&C Surf as final and binding as it relates to the content of this Campaign. By entering into this giveaway you are agreeing to be added to the T&C Surf mailing list.  Participants must stay subscribed for the duration of the giveaway. The winners will be pulled from each individual giveaway form on October 31st. If the participant unsubscribes before the date, they pull their name from the list and therefore are no longer entered to win the giveaway. Participation in the newsletter can be terminated at any time through a link at the bottom of the newsletter after 11/01/23. 

Limit one entry per person, household, IP address and/or email address. Entries will be deemed to have been submitted and made by the authorized account holder of the email address at the time of entry. The authorized account holder is the natural person who is assigned to the email address by an Internet access provider, online service provider, or other organization that is responsible for assigning such email addresses for its associated domain name. 

Any entry information collected from the Giveaway shall be used only in a manner consistent with the consent given by entrants at the time of the entry, with these Official Rules and with Sponsor’s Online Privacy Policy. False, fraudulent, or deceptive entries or acts will render entrant(s) and entries ineligible. By entering, the entrant agrees to be bound by these Official Rules and the decisions of Sponsor and Sponsor representatives in all matters relating to this Giveaway.

The prize is non-transferable, non-refundable and no cash alternative will be given. T&C Surf accepts no responsibility for any tax implications that may arise from accepting a prize and recommends that all entrants obtain independent financial advice in this regard.  If any act, omission, event or circumstance occurs which is beyond the reasonable control of T&C Surf and which prevents T&C Surf from complying with these terms and conditions, T&C Surf will not be liable for any failure to perform or delay in performing its obligations. Except in respect of liability for death or personal injury caused by its negligence, or for any fraud, fraudulent misrepresentation or any other liability which cannot be excluded by law, T&C Surf will not be liable for any losses, damages, expenses, costs or claims arising out of or relating to this Giveaway or the use of the prize, whether in contract, tort (including negligence), breach of statutory duty or otherwise.

In the event that a prize has been stolen or mishandled during shipment to an international destination, T&C Surf may not be able to replace the specific item(s). If the winner prefers a specific quicker shipping method, they are responsible to notify us immediately and will also be responsible to cover the additional costs, if any.

Winner Selection and Notification: Winner will be selected by a random drawing under the supervision of T&C Surf. Winner will be notified by email on November 1st, 2023. T&C Surf shall have no liability for Winner’s failure to receive notices due to spam, junk e-mail, or other security settings or for Winner’s provision of incorrect or otherwise non-functioning contact information. If Winner cannot be contacted, is ineligible, fails to claim the prize within 48 hours from the time award notification was sent, or fails to timely return a completed and executed declaration and release as required, the prize may be forfeited and an alternate Winner selected. Receipt by Winner of the prize offered in this Campaign is conditioned upon compliance with any and all federal, state, and local laws and regulations. ANY VIOLATION OF THESE OFFICIAL RULES BY WINNER (AT ALOHA COLLECTION’S SOLE DISCRETION) WILL RESULT IN WINNER’S DISQUALIFICATION AS WINNER OF THE CAMPAIGN, AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED. 

NOTE: Internet entries must be made by the entrant only at the website address: https://tcsurf.com Entries made by any other individual or any entity, and/or originating at any other Internet web site or e-mail address, including but not limited to commercial giveaway subscription notification and/or entering service site, will be declared invalid and disqualified for this Giveaway. Use of any device to automate the entry process is prohibited.

By entering the Giveaway, entrants consent to the use of their names, photographs, and related statements by Sponsor in advertising, promotional materials, and on its website, throughout the universe in perpetuity, without notice or compensation, unless prohibited by law.

By checking the box in the enter the win form, You, the Contestant, have affirmatively reviewed, accepted, and agreed to all of the Official Rules.
